A trademark search is essential; creating a similar logo, even unintentionally, can cause “likelihood of confusion” and lead to lawsuits. Seeking legal advice for a “clearance search” is highly recommended to ensure the logo is safe to use commercially. Using a similar logo in the same industry can lead to claims of infringement, requiring you to prove you used it first.

Create a unique, bespoke, or custom-designed logo to minimize the risk of conflict. You can protect your own logo by registering it with the United States Patent and Trademark Office (USPTO) or your country’s equivalent. If hiring a designer, ensure a contract exists that transfers all intellectual property (IP) rights to you. 

How do you want your audience to feel when they see your brand colors? Choosing high-contrast, simple color palettes (1-3 colors) can help avoid a cluttered look which makes logos harder to read on clothing and signage as well as assuring visibility from a distance. Prioritize CMYK or Pantone (PMS) color modes over RGB for consistent, accurate printing results. Select versatile colors that work on both light and dark backgrounds. Use light text on dark materials or dark text on light materials. Blue: Trustworthy, stable, and popular. Red: Bold, high-energy, and attention-grabbing. Green: Natural, calming, and eco-friendly. Yellow/Orange: Energetic, friendly, and attention-grabbing.
